1.Who we are

This website, tellaterra.com, is operated by Tella Terra, a micro-entreprise registered in France and run by Sonia and Mathieu. In these terms, "we", "us" and "our" mean Tella Terra. "You" means the person using the site or buying a product.

2.Agreeing to these terms

By browsing tellaterra.com, subscribing to our newsletter, or buying a product, you accept these terms. If you do not agree with them, please do not use the site or place an order. If you are buying on behalf of someone else, you confirm you are allowed to do so.

3.What we sell

Tella Terra makes gentle picture books for toddlers. Through this website we mainly offer:

• Digital picture books and coloring books delivered as downloadable files (usually PDF).
• Free and paid printables, songs, and activity sheets.

Some of our titles are also sold as printed books or gifts through third-party platforms such as Amazon and our print-on-demand shop. Those purchases are governed by the terms of the platform you buy them on, not by these terms.

We describe each product as accurately as we can. Screen colors and printed results can vary between devices and home printers.

4.Orders, prices and payment

Prices are shown on the product or checkout page and include applicable taxes where required. We may change prices at any time, but changes do not affect orders already placed.

Our payment partner and reseller

Payments for our digital products are processed by Gumroad, which acts as our Merchant of Record and authorised reseller. This means that when you buy a digital product, your order and payment are handled by Gumroad, Inc., and the Gumroad Terms of Service apply to that transaction alongside these terms. Gumroad handles billing, payment, invoicing and sales tax, and is the first point of contact for payment questions and refunds. The product itself is created and licensed to you by Tella Terra.

Where another checkout is used for a particular product, the payment provider for that product will be identified at checkout.

5.Your licence to use our digital products

When you buy a digital product, we give you a personal, non-exclusive, non-transferable licence to download it and use it for your own private, non-commercial enjoyment, including with the children in your own family.

Unless we agree otherwise in writing, you may not:

• resell, rent, sublicense, or share the files with others;
• upload them to public or file-sharing sites;
• use them for commercial purposes; or
• claim them as your own work.

You may print our printables for personal and family use. If a product is intended for classroom or group use, the allowed use will be stated on the product page.

6.Delivery of digital products

Digital products are delivered electronically, usually through a download link shown after payment or sent to the email address you provide. Please make sure your email address is correct. If a download does not arrive or does not work, contact us at contact@tellaterra.com and we will help.

7.Refunds

We want you to be happy with what you buy. We offer a 14-day satisfaction refund on digital products. The full details, and how to ask for a refund, are set out in our Refund Policy.

8.Intellectual property

All content on this site and in our products, including the books, illustrations, text, songs, logos, and the names "Tella Terra" and "Mira Sereni", is owned by us or our licensors and is protected by copyright and other rights. Buying a product gives you the licence described in section 5. It does not transfer ownership of any rights to you.

9.Acceptable use

Please use the site lawfully and fairly. Do not try to break, overload, or gain unauthorised access to the site, and do not use it to infringe anyone's rights or to do anything illegal.

10.Third-party services and links

Our site and checkout rely on trusted third parties, including Gumroad (payments), our newsletter provider, and our print and shop partners. Our pages may also link to other websites. We are not responsible for the content or practices of third-party sites, and their terms and privacy notices apply when you use them.

11.Our products and your expectations

Our books are made for enjoyment and gentle early learning. They are not professional, medical, or educational advice. We provide the site and products with reasonable care and skill, but we cannot promise the site will always be available or completely free of errors.

12.Liability

Nothing in these terms limits your rights as a consumer under French law, and nothing limits our liability where the law does not allow it (for example for death or personal injury caused by our negligence, or for fraud). Subject to that, we are not liable for losses that were not reasonably foreseeable or that do not result from our breach of these terms.

13.Your consumer rights

If you are a consumer in the European Union, you have statutory rights, including in some cases a 14-day right of withdrawal. For digital content that is delivered immediately, you may be asked to agree to start the download right away and to acknowledge that you then lose the statutory right of withdrawal. Independently of that, we voluntarily offer the 14-day satisfaction refund described in our Refund Policy. Your statutory rights are not affected by these terms.

14.Changes to these terms

We may update these terms from time to time, for example to reflect changes in what we offer or in the law. The version published here, with its "last updated" date, is the one that applies. Orders are governed by the terms in force when you placed them.

15.Governing law and disputes

These terms are governed by French law. If a dispute cannot be resolved between us, the courts of France will have jurisdiction, subject to any mandatory consumer protections in your country of residence.

If you are a consumer, you can also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
